Terms of Service

These Terms of Service ("Terms") govern your use of the Daily Capsule mobile application ("the app", "the service"). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, please do not use the app.

1. Who we are

2. What the app is

Daily Capsule is a daily reflection app. Each day, you receive one shared prompt and can write a private reflection in response. You may keep your reflection entirely private, or choose to share it anonymously to a worldwide feed where others can react to it.

The app is designed for emotional honesty, self-reflection, and a sense of shared presence. It is not a therapy service, a crisis service, or a substitute for professional mental health care.

3. Eligibility

You must be at least 16 years old to use Daily Capsule. By using the app, you represent that you meet this minimum age.

4. Your account

• On first launch, the app creates an anonymous account for you. This account is not linked to your name, email, phone, or any other personal identifier.
• You may optionally link your account to Sign in with Apple, Continue with Google, or a magic-link Email so that you can recover your reflections on a new device. Linking is entirely optional.
• You can delete your account and all associated data at any time from Settings → Delete my account. Deletion is immediate and irreversible.

5. Your content

5.1 Ownership

You retain full ownership of every reflection you write in the app.

5.2 License for shared reflections

When you tap "Release It" to share a reflection publicly, you grant Power of Life Labs GmbH a worldwide, non-exclusive, royalty-free license to:

• display your shared reflection in the app's anonymous feed,
• store it in our database to keep it available,
• translate it (with your translation consent) for readers in other languages,
• retain it for as long as your account exists.

This license ends as soon as you delete your account or remove the individual reflection (feature coming soon — for now, account deletion is the clearest path to remove content).

5.3 Responsibility

You are responsible for the content you write. You must not submit content that:

• threatens, harasses, or incites violence against any person or group;
• contains hate speech, slurs, or dehumanising language based on race, religion, gender, sexuality, ethnicity, or disability;
• depicts or sexualises anyone who is or appears to be a minor;
• doxxes or identifies other real people (names combined with phone, address, or other identifiers);
• is spam, advertising, or external promotional content;
• infringes someone else's intellectual property rights;
• violates any applicable law.

5.4 AI content moderation

Before a reflection is shared publicly, its text is automatically reviewed by our AI moderation system (Claude Haiku) to check for the content types listed above. If the system determines your reflection breaks these rules, it will be kept private in your archive and not shared. We do not tell you the exact reason, to prevent the filter from being gamed.

The moderation system also detects crisis language (active self-harm or suicidal ideation). In that case, it does not block your share — instead, it shows you a supportive sheet with crisis hotlines and lets you decide whether to share or keep the reflection private.

AI moderation is not perfect. If you believe your reflection was incorrectly blocked, you may email hello@daily-capsule.com.

6. Emotional support — important disclaimer

Daily Capsule is not a crisis service, therapy, or medical advice.

• Reflections and reactions from other users are anonymous and come from strangers. They are not trained professionals.
• If you are in immediate danger or considering self-harm, please contact emergency services, your local crisis hotline (shown in the crisis sheet inside the app), or a qualified mental health professional.
• Nothing in this app should be used as a substitute for professional care.

7. Acceptable use

In addition to §5.3, you agree not to:

• reverse engineer, decompile, or attempt to extract the source code of the app;
• use automated systems, bots, or scripts to interact with the service;
• interfere with the operation of the service or attempt to access other users' accounts;
• attempt to bypass content moderation or rate limits;
• impersonate another person through your alias or content.

We may suspend or terminate accounts that violate these rules, and we may hide or remove content that breaks them.

8. Reactions and shared reflections

Reactions are anonymous, lightweight signals of support. They are not direct messages. We do not offer a direct-message, comment, or reply feature and we do not plan to — this is a deliberate safety choice to prevent unsolicited advice during vulnerable moments.

9. Paid features

Certain features may be offered only to paid subscribers ("Pro"). The current paid features are:

• Automatic translation of shared reflections into your app language.
• Unlimited feed scroll (free users see a daily cap).

During our launch period, all features are available to all users at no cost. When the Pro tier is enabled, pricing, billing, and cancellation terms will be disclosed in-app before you subscribe.

10. Privacy

How we handle your data is described in our Privacy Policy. The Privacy Policy forms part of these Terms.

11. Intellectual property

The app's name, logo, design, code, and content created by us are owned by Power of Life Labs GmbH and protected by Swiss and international copyright and trademark law. You may not copy, modify, distribute, or create derivative works of our content without our written permission, except as permitted by applicable law.

12. Disclaimers

To the maximum extent permitted by law:

• The service is provided "as is" and "as available" without warranties of any kind.
• We do not warrant that the service will be uninterrupted, error-free, secure, or meet your expectations.
• We are not liable for the content of reflections written by other users, nor for any consequences arising from them.
• AI features (translation, moderation) are probabilistic and may produce errors or unexpected results.

13. Limitation of liability

To the maximum extent permitted by Swiss law, Power of Life Labs GmbH and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the service.

Our total aggregate liability for any claims related to the service shall not exceed CHF 100 or the amount you have paid us in the past 12 months, whichever is greater.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for intent or gross negligence, or for death or personal injury caused by our negligence.

14. Termination

• By you: you may stop using the app and delete your account at any time. Deletion permanently removes all your data within 30 days.
• By us: we may suspend or terminate your account if you materially breach these Terms, including violation of the content rules in §5.3.

15. Changes to these Terms

We may update these Terms as the service evolves. Material changes will be announced in-app before they take effect, and the "Last updated" date at the top of this page reflects the current version. Continued use after an update constitutes acceptance.

16. Governing law and jurisdiction

These Terms are governed by Swiss law, excluding conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods.

The exclusive place of jurisdiction for any dispute arising from or in connection with these Terms is Zurich, Switzerland, subject to any mandatory consumer-protection law in your country of residence.
